Recruiting Agent

I want to start business as a RA; I want to know the process of getting registered with Overseas Employment Division of MEA.

Ans:You will have to apply online for a new RC on the eMigrate system Public Website. Before you start to fill the online application form, please ensure you have a soft copy of the following mandatory documents required for this process:

1.Attested photograph of the Managing Director (MD)/ Managing Partner (MP)/Proprietor. (Attested from a central or a state government gazetted officer

2.Attested copy of PAN card of:

  • Company/Partnership firm/Proprietor
  • MD/MP
  • All Directors/All Partners
  • 3.Attested copy of the highest educational degree of the MD / MP / Proprietor

    4.Statement showing the name, age and residential address applicable for previous five years of All Directors/All Partners/ Proprietor, along with designation and business activities undertaken during the last five years

    5.In case of a company, the resolution passed to authorize one of the director to act as MD and sign papers on behalf of the company.

    6.In case of a partnership, attested copy of partnership deed.

    7.In case of a partnership, true extracts from the registrar of firms in support of registration of the partnership deed.

    8.In case of a company or a partnership, a copy of the balance sheet of the previous financial year.

    9.In case of a company or a partnership, a copy of the balance sheet of the previous financial year.

    10.In case of a company, a copy of the articles of association.

    11.In case of a company, a copy of the certificate of registering the company.

    12.Income tax return for last three years of:

  • Company/Partnership firm/Proprietor
  • MD/MP
  • All Directors/All Partners
  • 13.Assets and liabilities statement of MD/MP/Proprietor for last three years assessed by certified CA with membership number and address.

    14.If office is leased or rented, the registered and notarised lease/rent agreement.

    15.If office is leased or rented, latest lease/rent receipt.

    16.Attested specimen signature of MD/MP/Proprietor.

    17.A copy of the blue print of the layout plan of the office duly signed and stamped by a government approved architect with registration and membership number.

    18.If office is leased or rented, NOC from owner of office on a duly notarized affidavit.

    19.Valuation report of assets in your office premises, by a registered valuer with registration number and membership number.

    20.A copy of the latest landline telephone bill in the name of the Agency.

    21.A copy of the trade testing certificate along with photograph.

    22.If office is owned, then a copy of the ownership deed / proof of office premise.

    23.Attested copy of RC under shop and establishment act.

    24.Duly notarized affidavit that agency has not been involved in any recruitment business before.

    25.In case of partnership, a copy of the resolution passed to authorize one of the partner to act as Managing Partner and to sign papers on behalf of the firm.

    26.In case UID is available, attested copy of aadhar card of MD / MP / all directors / all partners / proprietor.

    27.Any other document that may be notified by the Ministry from time to time.

    Steps to be followed:

    After you have arranged for the above mandatory documents, please follow the below mentioned steps to apply for a new RC:

    1.Open the eMigrate Public Website- http://www.eMigrate.gov.in in a web browser.

    2. Go to Recruiting Agent -> New Registration.

    3.Fill the recruiting agent registration application form consisting of:

  • Organisation details
  • MD/MP/Proprietor details
  • Directors/Partners details
  • Other details
  • Upload the required documents
  • Confirm the data entered, or edit to make any changes.

    4.Make online payment of application fee through credit card/ debit card/direct debit.

    5.On successful payment, system generates:

  • Application Reference Number (ARN)
  • Printable application form
  • Payment receipt
  • 6.Submit the signed printed application form, along with attested copies of all the documents uploaded with the online application form, at the jurisdiction PoE office.

    7. The PoE office will carry out necessary scrutiny of your application before forwarding the application to the PGE office for further processing.

    8.If some further clarifications/inputs are required from you, the PoE can send back the application for re-submission. In such a case, you will receive a system generated mail containing instructions for re-submitting the application along with the required documents.

    Else

    If no further clarifications/inputs are required from you, the PoE will forward your application to the Protector General of Emigrants (PGE) office through the eMigrate system.

    9.The PGE office will process your application. If the application is in-principle approved by the PGE, the PGE office will mail a signed hard copy of the eligibility letter at your registered office address.

    Else

    If your application is rejected by the PGoE, a system generated email will be sent to you informing of the rejection.

    10. Within a month of receiving the eligibility letter, deposit a Bank Guarantee (BG), of an amount notified by the Ministry for this process, through mail or in person at the PGE office.

    11.After verification of the BG by the PGE office, the application will be approved and a system generated email would be sent to your email id containing:

  • A unique RA id assigned
  • A copy of the RC
  • URL for registering the Digital Signature Certificate (DSC)
  • Temporary password for registering the DSC
  • 12. The PGE office will also send the signed hard copy of the RC at your registered office address.

    Can I know the status of my application?

    Ans:Yes, you can know the status of your application through the Application Reference No.(ARN). Please follow the below mentioned steps:

    1.Open the eMigrate Public Website- http://www.eMigrate.gov.in in a web browser.

    2.Go to Recruiting Agent -> Track status

    3.Enter your application´s ARN and click ´Submit´.

    What is a Digital Signature Certificate (DSC)? What will it be used for?

    Ans: A DSC is an electronic key used for ensuring source authentication, data integrity and ensuring non-repudiation of digitally signed documents.

    Once your application for a new RC is approved by the PGoE, you will be able to log on to the eMigrate system Restricted Website. For all services of Overseas Employment Division of MEA, you will have to apply online through this portal. For accessing this system, you will require your RA ID (which will be your username) and a DSC(which will be your password).

    I do not have a DSC.

    Ans:You will have to buy a DSC from a certifying authority (CA). The DSC can be acquired from any of the CAs authorized by the Controller of Certifying Authorities (CCA). The CAs authorized by CCA are:

    The DSC acquired should have the following specifications:

  • Class2 or Class3 type
  • Issued to individuals or business organizations
  • I have acquired a DSC. How to use it?

    Ans:You will register the acquired DSC on the eMigrate system. Please follow the below mentioned steps::

    1.Open the URL for registering the DSC mentioned in the system generated email on approval of your application for a new RC.

    2.Enter the details required, upload the DSC and click ´Register´.

    3. eMigrate system validates the data entered and registers the DSC against your RA id.

    You can now log on to eMigrate system Restricted Website using your RA id(as username) and registered DSC(as password).

    I have received an email from the eMigrate system for re-submitting my application. What should I do?

    Ans:If some further clarifications/inputs are required from you, the PoE can send back the application for re-submission. In such a case, you will receive a system generated mail containing instructions for re-submitting the application along with the required documents.

    Ans:After you have successfully submitted your online application, a unique no. will be generated by the system known as the application reference number (ARN). You can use this number to track the status of your application through the eMigrate system.

    I want to recruit Indian workers. What is the required process?

    Ans:The Employers need to apply to Indian Mission/Consulate in their country either online through eMigrate system or offline by submitting physical documents as required by the respective Indian Mission/Consulate. Only Employers accredited by Indian Missions can apply online for demand approval/permit approval to Indian Missions, for recruiting Indian workers

    What is accreditation

    Ans. All Employers in notified countries will be accredited by the Indian Mission in their country, as and when the Indian Mission decides so. Under this process, details of the Employer will be verified by the Indian Mission officials. The Employer will be required to submit a breakup of projected manpower requirement for the next 5 years from the date of applying. This projected manpower requirement when approved by the Indian Mission will be known as the capacity. The Employer will not be able to recruit Emigrants more than the capacity approved.

    How to apply for accreditation?

    Ans: You will apply for accreditation through the eMigrate system Public Website. Before you start to fill the online application form, please ensure you have a soft copy of the following mandatory documents required for this process:.

    1.Copy of specimen employment contract

    2.In case of a company and if operational office country is different from incorporation office country, then a copy of certificate of incorporation, if registered outside the country of operation.

    3.Copy of:

  • Registration certificate from Registrar of Companies (RoC) in case of a company.
  • Registration certificate from Registrar of Firms (RoF) in case of a partnership.
  • Personal identification number in case of individuals.
  • 4.In case of a company, a copy of the memorandum of association.

    5.Copy of letter of authorization.

    6.In case of a company, a copy of the article of association.

    7.If registration number to import manpower is available, a copy of the certificate to import manpower.

    8.In case of a partnership, a copy of the partnership deed.

    9.Copy of specimen signature of authorized signatory.

    10.Any other document that may be notified by the Ministry from time to time.

    1.Open the eMigrate Public Website- http://www.eMigrate.gov.in in a web browser.

    2.Go to Project Exporter -> Apply for Accreditation.

    3.Fill the Employer accreditation form.

    4.Confirm the data entered or edit to make any changes.

    5.Submit the signed application form along with the required documents at the respective Indian Mission.

    6.The Indian Mission processes your application:

    If some further clarifications/inputs are required from you, the Indian Mission can send back the application for re-submission. In such a case, you will receive a system generated mail containing instructions for re-submitting the application along with the required documents.

    Else

    As a part of the application processing, an Indian Mission official may visit your premises.

    7.If the application is approved by the Indian Mission, a system generated mail containing the following will be sent to your email id:

  • A unique Employer id assigned
  • Printable confirmation letter with bar code
  • Password for accessing eMigrate system Restricted Website
  • Else

    If your application is rejected by the Indian Mission, a system generated email will be sent to your email id informing of the rejection.

    What is capacity enhancement?

    Ans:An accredited Employer can apply for capacity enhancement if the Employer feels that more manpower will be required than the capacity approved. The application for the same will be filled online by logging on the eMigrate system Restricted Website.

    Project Exporter

    I want to send my employed workers to a notified country. What is the required process?

    Ans:You need a valid permit issued by the Overseas Employment Division of Overseas Employment Division of MEA to send workers abroad. Only project exporters accredited by Protector General of Emigrants (PGoE) can apply for permit approval to the PGoE office, for recruiting Indian workers. You will apply for accreditation through the eMigrate system Public Website.

    What is accreditation?

    Ans:All project exporters must be accredited by the PGoE office before they can apply for permit to send their workers/employees to notified countries. During the accreditation process, the details of the project exporter will be verified. A field visit may also be conducted by the PGoE officer.

    How to apply for accreditation?

    Ans:Before you start to fill the online application form, please ensure you have a soft copy of the following mandatory documents required for this process:

    1.Copy of:

  • Registration certificate from Registrar of Companies (RoC) in case of a company.
  • Registration certificate from Registrar of Firms (RoF) in case of a partnership.

    What is emigrant registration?

    Ans:Emigrant registration is the process through which an Emigrant will submit his/her information on eMigrate system.

    For Emigrants having ECR passports and going to notified (ECR) countries, they will be given electronic emigration clearance by the Protector of Emigrants (PoE) through the eMigrate system.

    For Emigrants having ECNR passports, the registration is auto approved.

    I have been recruited for employment in an ECR country through a Recruiting Agent (RA) registered with Overseas Employment Division of MEA and has a valid demand letter; or by a Project Exporter (PE) who is accredited with Overseas Employment Division of MEA and has a valid permit; or by a foreign Employer who is accredited with Indian Mission and has a valid permit. How will my emigrant registration be done?

    Ans:The respective RA/PE/Employer, as the case may be, will do the Emigrant Registration on your behalf.

    I have been recruited directly by an Employer in an ECR country? How do I apply for Emigrant registration?

    Ans:You have to apply for Emigrant registration through the eMigrate system Public Website.

    • If the Employer is registered on eMigrate system, following details will be shared by the Employer with you:
    • 1.Job ID

      2.Job Code

      3.Employment contract signed by Employer

    • In such a case you have the fill the online form and upload the required documents in Emigrant -> Apply for Registration for ECR Countries -> Employer Registered on eMigrate system.

    • If the Employer is not registered on eMigrate system, following details will be shared by the Employer with you:
    • 1.Demand Letter attested by Indian Mission

      2.Employment contract signed by Employer

      3.Copy of Visa

    In such a case you have the fill the online form and upload the required documents in Emigrant -> Apply for Registration for ECR Countries -> Employer Not Registered on eMigrate system.

    In such a case you have the fill the online form and upload the required documents in Emigrant -> Apply for Registration for ECR Countries -> Employer Registered on eMigrate system.

    Can I know details about an employer?

    Ans:Yes, you can know details about an employer. Please follow the below mentioned steps:

    1.Open the eMigrate system external portal- http://www.eMigrate.gov.in in a web browser.

    2. Go to Find Employer or Search -> Find Employer/PE.

    3. Enter the employer name/employer id/PE id and submit.

    The details of the employer will be displayed on the screen.

    Can I know details about a recruiting agent?

    Ans:Yes, you can know details about a recruiting agent. Please follow the below mentioned steps:

    1.Open the eMigrate system Public Website- http://www.eMigrate.gov.in in a web browser.

    2.Go to Find Recruiting Agent or Search -> Find RA.

    3.Enter the agent name/agent id and submit.

    The details of the recruiting agent will be displayed on the screen.

    I want to raise a grievance against a employer/PE/ RA. What are the steps to be followed?

    Ans:Please call OWRC helpline number given on the home page of emigrate.gov.in. The OWRC official will record your grievance and will tell you the application reference no. for future tracking.

    If you want to submit grievance details directly on the website, please follow the below mentioned steps:

    1. Open the eMigrate system Public Website- http://www.eMigrate.gov.in in a web browser.

    2.Go to Emigrant -> Submit Grievance.

    3.Fill the online form and submit

    The grievance will be registered by the system and will be forwarded to the concerned person.

    How can I track my grievance resolution?

    Ans. You can track the status of grievance resolution by the application reference no. generated after the grievance has been successfully submitted in the system. You can also track the status of grievance by calling OWRC helpline.

    What is meant by notified countries?

    Ans:Notified countries are notified by the Ministry from time to time. These may also be referred to as ECR countries. Currently there are seventeen notified countries identified by Overseas Employment Division of MEA::
